    Mobbing - Menschenrechtsverletzungen in Deutschland Diese Seite beschäftigt sich mit dem Thema Mobbing in der Arbeitswelt, dessen Multidisziplinarität in einem detailorientierten Forum und einem interaktiven Wiki zum Ausdruck kommen soll. Da der Schutz vor Mobbing vom europäischen Arbeitsschutzrecht ausgeht, wird hier ein besonderer Schwerpunkt gesetzt. Denn ein wesentliches Kriterium von Mobbing ist die nahezu vollständige Auflösung der Wirksamkeit des Europäischen Arbeitsschutzes unter Missachtung insbesondere der Charta der Grundrechte der Europäischen Union bzw. des Vertrages von Nizza -, der Konvention zum Schutze der Menschenrechte - EMRK - sowie der Charta der Vereinten Nationen in Verbindung mit der Allgemeinen Erklärung der Menschenrechte. Mobbing in der Arbeitswelt erfährt eine stetig wachsende Verbreitung in den Betrieben und Unternehmen der Bundesrepublik Deutschland, da eine hierauf abgestellte wirksame und zeitnahe Intervention insbesondere durch die Exekutive und durch die Judikative in aller Regel nicht stattfindet, wobei sich die politische Einflussnahme auf diese Schutzinstanzen den Mobbingproblemen in den eigenen Landesbetrieben flexibel anzupassen scheint. So kann beobachtet werden, dass das Arbeitsschutzgesetz, das seine Entsprechung in der EU Richtlinie "Arbeitsschutz" - 89/391/EG hat, für den Schutz von Mobbing-Betrioffenen auch im Rahmen der Überwachung aufgrund § 17 (2) oder des § 21 ArbSchG durch die Gewerbeaufsicht bzw. Arbeitsschutzbehörden kaum mehr eine Bedeutung findet. - Auch trotz der Tatsache, dass der innerbetriebliche Schutz vor Mobbing mittels der Aufgaben für Betriebärzte und Fachkräfte für Arbeitssicherheit (FaSi) nach dem deutschen Arbeitssicherheitsgesetz eigentlich sichergestellt werden müsste. Angesichts diverser Urteile bundesdeutscher Arbeitsgerichte scheint es, dass der gemeinschaftsrechtliche Konsenz zum Schutz der Beschäftigten vor Mobbing auch an diesen Stellen mehr an Bedeutung erfahren muss. Zur Vermeidung von millionenfachen arbeitsbedingten Erkrankungen oder Berufskrankheiten oder Unfällen - in Folge von Mobbing - ist es deshalb dringend erforderlich und gesundheitspolitisch unabdingbar, dass die Politik hier nunmehr starken Einfluss geltend macht, damit auch das Verursachungsprinzip entsprechend Artikel 174 des EG Vertrages überhaupt eine Gewichtung erhält, da mobbingbedingte Krankheitskosten immer noch zu Lasten der Allgemeinheit und nicht zu Lasten des Verursachers bzw. des Normadressaten für das Arbeitsschutzgesetz (Rl. 89/391/EWG) gehen. Mobbing in der Arbeitswelt bezeichnet nicht mehr nur ein thematisch oder regional begrenztes Phänomen in der Arbeitswelt.- Als anerkannte Form der Gewalt entzieht der Psychoterror dem Rechtsstaat das verfassungs- und gemeinschaftsrechtliche Gerüst und berührt somit vorgesehene betriebliche Schutznormen ganz erheblich.
